PUPPY GUARANTEE/PURCHASE AGREEMENT
THIS AGREEMENT is made this __________ day of _________, 20___, by and between__________________, residing at ________________________________, hereinafter referred to as Buyer, and _________________Sand Lake Kennels/Nancy Jark Krumm, residing at 11647 396th Ave. Columbia, SD 57433, hereinafter referred to as Seller. Dog to be purchased is described herein: Call Name: ___________________________ Date of Birth:________________ Sex: _____________ Breed: ___________________ Color: _________________ Deposit Amount: ________________ Total Purchase Price: ____________________ plus___________ 4.5% SD State Tax. Transportation of puppy is additional and billed at cost, to include shipping kennel, health certificate and transportation/ flight. Transportation must be paid in full prior to shipment.
Congratulations on the purchase of your new puppy! We want your puppy to give you much joy. In order to accomplish this, we have prepared this contract to help you in the care of your new puppy. At the time of purchase, all puppies be up to date on worming and vaccinations and will have a puppy package that includes shot record, sample of puppy food and favorite toy. Please read the following statements below and sign your agreement at the bottom:
I, the Buyer, understand that the Seller will guarantee the puppy to be in good health at the time of the sale or the puppy will be replaced decided by the seller. Buyer must take the puppy(s) to a licensed Veterinarian within 48 hours or 2 business days of purchase at the Buyer’s expense for this guarantee to remain valid. Any additional veterinary care is solely the responsibility of the Buyer. Any vaccinations or medications given during this 2 day/48 hour period may render this health guarantee null and void. I, the Buyer, understand that any accidents that may occur or anything that the puppy ingests after leaving the care of the Seller is the Buyer’s responsibility. Each puppy(s) comes with a limited genetic health guarantee against genetic defects of the heart, liver, kidneys and lungs for two (2) years from date of purchase. The Buyer must contact the Seller within 24 hours of the exam if any problems have been found and provide Seller with a copy of your Veterinarian’s written certificate stating the exact genetic defect found. In the event a genetic defect is found, the Buyer’s licensed Veterinarian must provide the Seller with a written certificate stating the exact cause. Sellers licensed Veterinarian will review the Buyer’s Veterinarian’s report, and if in agreement as to the presence of a genetic defect as listed above, or that a puppy’s death was caused by a genetic defect listed above and not due to neglect, accidents, or sickness at the puppy’s new home, the puppy will be replaced with one of equal value as soon as one becomes available. If these regulations are not met the Guarantee becomes null and void. Seller does not refund money, and Buyer will be responsible for any Veterinarian expenses and any expenses incurred to return the puppy to the Seller or to have a replacement puppy shipped to the Buyer. This guarantee only applies to the original Buyer.
I, the Buyer, understand that the Seller does not guarantee against Parvo or any kind of bacteria and/or viruses after 48 hours of purchase. I also understand that vaccination for these diseases does not guarantee that the animal will not contract a disease. Please keep the puppy away from any unhealthy pets or areas that have been infected. If the puppy has sustained health problems resulting from injury, or mistreatment or neglect after leaving the Seller, the Seller will not assume responsibility for it and no refund will be forthcoming. There may be exceptions, to be determined by the Seller. If abuse or neglect is found to be the case, the Seller may demand the puppy to be return at the Buyer’s expense. The Seller states that puppies have received the following vaccinations – Distemper-Hepatitis, Leptospirosis-Parainfluenza and Parvovirus. Seller will inform Buyer of when a booster is due. Seller worms puppies with PYRANTEL and/or PANACUR. The Buyer agrees that this puppy will be given adequate and proper shelter and housed securely. This dog shall not be neglected, allowed to roam free, or be mistreated in any manner. The puppy shall receive proper veterinary care throughout its life, receiving annual inoculations and placed on a heartworm preventative. The puppy shall receive proper nutrition and care shall be taken to maintain its proper weight. The Buyer will notify the Seller first if for any reason the Buyer no longer wants to or is unable to keep the puppy. The Seller shall have first right of refusal if the puppy is to be sold or disposed of in any way. If the Seller does not want to acquire the dog, the Seller will assist the Buyer in placing the puppy if the Buyer so chooses. The Seller warrants and agrees that they are the lawful owner of this puppy and is alone responsible for entering into this contract with the Buyer. The Seller does not guarantee size, coat, color, un-descended testicle, under bite or overbite or fertility once the puppy has left our premises. Also, we do not warranty against hypoglycemia, umbilical hernia, retained puppy teeth, coccidiosis, giardia, ear mites, external/internal parasites, viral or bacterial infections that may occur after the puppy is brought into your environment. No guarantees or warranties, expressed or implied, are given by Sand Lake Kennels and Nancy Jark Krumm, the Seller, except those stated herein.
By signing this form, I am stating that: I have read this two-page form, and understand what I have read and agree to this purchase and contract.
